View Full Version : Unfairly dismissed from work?

Hey.

I've been dismissed from work, and don't have a clue what i can do about it. Any ideas?

Here's what's happened, from the top.

I've been working at hobby stores, southampton, for approximatly 4 years now, working part time, whenever i have the opportunity. Recently we've been under a lot of pressure because of Stock Take. Today, 26th January '07, a minor dispute over my actions during a sale esculated to the store manager threatening to dismiss me. I told the manager that he couldn't talk to me like that, at which point he responded, and i quote: "You're only part time staff, i can talk to you however i want." I ended up walking out the door because i couldn't take his abuse any longer.

My main problem is that there was no contract in place, so i don't know if there's any action i can take in this situation.

Is it simply a matter of finding another job now? =(

But you quit right? So you cant claim unfair dismissal?

However, you could probably claim some kind of working conditions suit. A bit of a long shot though.

? is do you really want to continue to work there ?
harrassment is almost impossible to prove ends up in a 'he said I said' loop
if you didn't say 'I quit' before you 'walked out' then you could go back and explain that you have been under a lot of 'stress' lately -homelife,school pressure,work ect.
explain that you enjoy working in the postiton and that you will make effort to conform to His ways of doing things and that you will try to better manage your Stress related problems.
most managers will see the wisdom in giving you a second try [makes his work easier not having to retrain new staff ect]
But again the ? in the end still is "do you really want the job"

You want to take legal action over a part time hobby job that you walked out on? That case will hold up for about 5 minutes.

Well, not necessarily legal action, but i don't wanna stand by while 4 years of hard work dissapears without so much as a reference.

Thanks for your thoughts, they're very helpful. I suppose the answer to the big question is yes, i would still want to work there. Thankfully though i didn't say "i quit", and as for the stress.. that was Ian (store manager) entirely. When i went into work this morning i was in a good mood.

Without me there's only 2 people in the shop... so they'll need me to come back. This is quite an interesting situation!

EDIT:

I've spoken to the management above him, and they're going to have some harsh words with him, they've asked if i can come into work tomorow and continue as if it never happened. I'd like to do this, but do you think it'd be a good idea to say anything else before it's all brushed under the rug?

Now is your chance to either get a contract or get something in writing. If Managment asked you back, you must have been right;they should be willing to do something. Maybe even a pay raise or promotion.

stress is a catch all that I find work great in situations like the above ,give both parties an out if needed in the end.. also if needed can be used with the higher levels of managment as an out for either party.

yes go in early ask for a sit down with him ..bury the knife[just not in him} ..let it all go by the way side ie.under the rug . a week for now all should be as it was or mabe better ..as you will both has a better understanding of expactations for the future LUCK .F
